As Sony Electronics Inc.'s Regulatory Affairs and Commercial Counsel, you will be a critical member of the Legal team, as the primary regulatory counsel for the Sony Electronics business in the US and Canada. Working from our San Diego, CA headquarters, you will be responsible for leading our efforts to review, anticipate, and comply with a variety of laws and regulations that impact our business. This will include advising the business, supporting key stakeholders regarding market and industry association strategy, and interacting directly with applicable regulatory agencies and trade associations. Primary focus will be on consumer and professional electronics products and services, like IoT devices, accessibility of products/services, cybersecurity, and related FCC support, as well as consumer protection, packaging and labeling, and guiding overall regulatory strategy.

You will also be responsible for providing expert legal advice and support on a broad range of commercial contracts, advertising, and compliance matters in support to varying business teams in connection with a range of new and emerging products. The successful candidate will work closely with internal stakeholders, including business and marketing teams, to ensure compliance, mitigate risks, and facilitate business objectives in alignment with the company's strategic goals.

The Regulatory Affairs and Commercial Counsel will report to the Assistant General Counsel and will also be expected to effectively collaborate with key Legal team members and business stakeholders at all levels of the company.

Responsibilities:

  • Monitor, identify, and track regulatory initiatives that may impact the business.

  • Provide guidance across multiple areas of the business on applicable regulations and laws, as well as agency and legislative proceedings, for current and future products and services.

  • Formulate and maintain appropriate internal guidance and processes to ensure compliance with laws and regulatory obligations.

  • Advise Legal team members on regulatory issues to be considered in supporting the business in broader commercial strategies.

  • Interacting with, and representing our interests before, federal, state, and local regulatory agencies.

  • Manage, respond to, and submit agency related filings and inquires.

  • Monitor and support company strategy and participation in multiple trade associations, business coalitions, and working groups.

  • Coordinate with global and local Sony business teams in connection with policy/regulatory developments - both to advise and understand internal needs and concerns.

  • Collaborate with external relations and government affairs personnel within Sony Electronics, as well as other relevant Sony companies to consider and support our public policy initiatives.

  • Select and manage consultants and/or outside counsel in connection with regulatory and legal compliance matters.

  • Provide guidance on evolving regulatory requirements and lead internal efforts to meet compliance obligations.

  • Draft, review, and revise filings with government agencies - directly and indirectly through trade associations.

  • Draft, review, negotiate, and manage a variety of complex commercial contracts, including vendor agreements, service agreements, purchase agreements, NDAs, advertising / marketing / influencer agreements, SAAS agreements, and licensing deals.

  • Advise on legal issues related to advertising and marketing strategies, including regulatory compliance (e.g., FTC guidelines, CAN-SPAM, FDA, FCC, EPA, DOE, etc.), intellectual property protection, and consumer protection laws.

Minimum Qualifications:

  • Juris Doctorate degree.

  • 7-10 years of related experience and qualified to practice law, either as an active member in good standing with the State Bar of California, or as registered in-house counsel in California.

  • Ability to work in a fast-paced, dynamic environment while managing multiple priorities and deadlines. A proactive, hands-on approach with a keen ability to anticipate issues and mitigate risks before they arise.

  • Experience in advising companies regarding the activities of United States regulatory agencies, including advising on matters involving competition authorities.

  • Substantial experience advising clients responding to subpoenas, CIDs, and interview requests from competition authorities and other regulatory agencies.

  • Comprehensive understanding of regulatory compliance across multiple jurisdictions, including industry-specific regulations (e.g., medical devices, consumer products, etc.).

  • A strong understanding of the typical regulatory process, and the ability to efficiently review, interpret, and analyze complex legal information.

  • A strategic mindset with an ability to identify and recommend the best course of action even in ambiguous situations.

  • Ability to work effectively with in-house business clients, translating legal concepts into practical, business-oriented solutions.

  • Outstanding oral, written, and interpersonal communication skills with the ability to build relationships and collaborate with colleagues, senior leaders and cross-functional teams.

  • Ability to work cross-functionally with multiple stakeholders, including legal, government affairs, PR, and business teams.

  • Strong judgment and decision-making skills.

  • Ability to manage multiple matters with minimal direction.

  • A keen working understanding of industry association roles, responsibilities, and benefits.

  • Strong expertise in drafting, reviewing, and negotiating complex contracts, and advising the business on commercial matters generally.

Preferred Qualifications:

  • Experience in advising companies regarding the activities of Canadian regulatory agencies

  • Experience working with relevant industry trade associations.

  • Experience managing outside counsel.

  • Previous experience in a corporate legal department.

  • Specific experience with multiple of the following agencies: FCC, FTC, EPA, DOE, NITSA, FAA, or FDA.

The anticipated base pay range for this position is $153,618.00 to $204,825.00. The actual base salary offered depends on a variety of factors, which may include as applicable, the qualifications of the individual applicant for the position, years of relevant experience, specific and unique skills, level of education attained, certifications or other professional licenses held, and the location in which the applicant lives and/or from which they will be performing the job.

In addition to a competitive base salary this position is also eligible for a bonus, and a comprehensive benefits package including healthcare benefits (medical, dental, and vision), paid medical leave after three months of employment, a 401k plan with matching company contributions, vacation time, education assistance, student loan assistance program, eighty hours of paid sick leave time annually, and up to twelve weeks paid parental leave after six months of employment.
